Brevet Capital has secured approval of the first I-829 petition tied to the JW Marriott Bonnet Creek Resort & Spa, marking the successful completion of the EB-5 immigration process for an investor in the Orlando luxury hotel project.

The approval was granted by U.S. Citizenship and Immigration Services (USCIS) and relates to an investor in the $282 million development, which opened within the gates of Walt Disney World. Brevet said the petition was approved approximately four months after filing through BC Immigration Fund LLC, its SEC-registered EB-5 investment platform.

Approval of the I-829 petition represents the final step in the EB-5 program, which allows foreign nationals to obtain U.S. permanent residency through qualifying investments in job-creating commercial enterprises. At this stage, investors must demonstrate that their capital was sustained and that the project met job-creation requirements throughout the conditional residency period.

With the petition approved, the investor and eligible family members are expected to receive unconditional permanent resident status.

“This first I-829 approval is a significant milestone for BCIF and our investors,” Joan Hull, director of EB-5 capital development at Brevet Capital, said in a statement. “It validates both the execution of this project and the real economic impact the EB-5 program can deliver. We’re proud of the outcome at JW Marriott Bonnet Creek and look forward to continuing this momentum across our portfolio.”

The JW Marriott Bonnet Creek Resort & Spa is a 516-room, 18-story luxury hotel positioned inside one of the most heavily traveled leisure destinations in the world. The property features more than 50,000 square feet of meeting and banquet space, a full-service luxury spa, multiple specialty dining venues, resort-style pools, and a rooftop terrace with views of Walt Disney World’s nightly fireworks.

From an investment and development standpoint, the project brought together several major players. It was developed by Schar Holdings, constructed by PCL Construction Services, and designed by architecture and engineering firm Huitt-Zollars.

For the hospitality sector, I-829 approvals tied to large-scale hotel developments such as JW Marriott Bonnet Creek provide a critical proof point for the EB-5 program’s role in financing capital-intensive projects, particularly those that generate significant permanent employment.

Brevet Capital said the approval underscores its ability to guide EB-5 investors through the full immigration lifecycle while delivering completed, operating hospitality assets tied to high-demand markets.
